You have to prove any one of these - 

  1. Duty of Care: The defendant owed a duty of care to the plaintiff. This means that the defendant had a legal obligation to act reasonably and avoid causing harm to others. The specific duty of care depends on the relationship between the parties and the circumstances surrounding the case.

  2. Breach of Duty: The defendant breached their duty of care by failing to act as a reasonably prudent person would in similar circumstances. The plaintiff must show that the defendant's conduct fell below the expected standard of care.

  3. Causation: There must be a causal connection between the defendant's breach of duty and the harm suffered by the plaintiff. The plaintiff must establish that the defendant's actions (or lack thereof) directly caused or significantly contributed to their injuries or losses.

  4. Damages: The plaintiff must demonstrate that they suffered actual damages or harm as a result of the defendant's breach of duty. Damages can be physical, emotional, or financial in nature, and they may include medical expenses, pain and suffering, loss of income, property damage, or other losses.
